Right of Withdrawal and Cancellation

If you are a consumer habitually resident in a Member State of the EU or the EEA, you have a statutory right of withdrawal for distance contracts (e.g. bookings made by email, phone, video call or online scheduling) under the mandatory consumer-protection provisions of your state of residence (national transposition of Directive 2011/83/EU on consumer rights). The following applies:

You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day the contract is concluded.

To exercise your right of withdrawal, you must inform us (CuraCap Schweiz GmbH, Schänzlistrasse 37, 2545 Selzach, Switzerland, email: christine@yourfacedesigner.com) of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post or an email). To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

If you withdraw from this contract, we shall reimburse to you all payments received from you without undue delay and in any event not later than fourteen days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.

If you requested that the services begin during the withdrawal period, you shall pay us an amount which is in proportion to the services already provided until the time you inform us of the exercise of the right of withdrawal, in comparison with the full scope of the services provided for in the contract.

For service contracts, the right of withdrawal expires early if we have fully performed the service and only began performing it after you gave your express consent and at the same time acknowledged that you lose your right of withdrawal upon full performance of the contract by us.

If you wish to withdraw from the contract, you may complete the following form and return it to us (its use is not mandatory):

“To CuraCap Schweiz GmbH, Schänzlistrasse 37, 2545 Selzach, Switzerland, email: christine@yourfacedesigner.com — I/we (*) hereby withdraw from the contract concluded by me/us (*) for the provision of the following service: … — Ordered on (*)/received on (*): … — Name of consumer(s): … — Address of consumer(s): … — Signature of consumer(s) (only if this form is notified on paper): … — Date: … (*) Delete as appropriate.”

Swiss law does not provide a general statutory right of withdrawal for service bookings of this kind. The specific cancellation terms are agreed in writing at the time of booking; we aim for accommodating solutions.
